Purchase rules

1. General provisions
1.1 These Terms and Conditions of Purchase and Sale (hereinafter referred to as the "Terms and Conditions") regulate the rights, duties and responsibilities of the person (hereinafter referred to as the "Buyer") purchasing goods from www.medeine.lt and Medeine.lt (hereinafter referred to as the "Seller"), as well as other relations related to the purchase - sale of goods. By purchasing goods in the e-shop, the Buyer confirms that he/she understands these Terms and Conditions and will comply with them.
2. Protection of personal data
2.1 When ordering goods in the e-shop www.medeine.lt, the Buyer must provide the following data necessary for the execution of the order: name, surname, delivery address, telephone number and e-mail address.
2.2 The Seller confirms that the data provided by the Buyer will be used only for the purpose of the purchase and sale of goods in the e-shop www.medeine.lt. The Seller undertakes not to disclose this information to third parties, except for the Seller's partners providing delivery or other services related to the execution of the Buyer's order. In all other cases, any Buyer's personal data may only be disclosed to third parties in accordance with the procedure provided for by the laws of the Republic of Lithuania.
3. The moment of conclusion of the sale and purchase agreement
3.1 The contract between the Buyer and the Seller shall be deemed to be concluded from the moment when the Buyer, having selected the product and formed an order, where he/she has indicated all the data necessary for placing the order, having read these Terms and Conditions, clicks on the button "Confirm".
3.2 Each contract concluded between the Buyer and the Seller shall be archived in the Medeine.lt database.
4. Buyer's rights
4.1 The Buyer shall have the right to purchase goods in the e-shop www.medeine.lt in accordance with these Terms and Conditions and the laws or regulations of the Republic of Lithuania.
4.2 The Buyer has the right to withdraw from the contract of sale of the goods concluded in the e-shop www.medeine.lt by notifying the Seller in writing no later than 14 days from the date of delivery of the goods, unless the contract of sale has been concluded for:
4.2.1. The sale of audiovisual works and phonograms in any video or audio media, computer programs, if the User has violated the packaging protections.
4.2.2. goods which have been made to the Buyer's individual order or which are obviously tailored to the Buyer's requirements or which, by their nature, cannot be returned to the Buyer after delivery due to loss of merchantability.
4.2.3. after the purchase of goods (Retail Rules, p. 17): machinery and mechanical equipment, electrical machinery and equipment, sound recording and reproducing apparatus and television video and sound recording and reproducing apparatus, land vehicles, ships, boats and floating equipment, optical, photographic, cinematographic, measuring, control, medical or surgical instruments and apparatus, watches, musical instruments, quality goods may only be returned and exchanged upon the Seller's consent.
4.2.4. in other cases where the sale and purchase agreement cannot be revoked under the laws of the Republic of Lithuania.
4.2.5.The Buyer's right to exchange and return goods of inadequate quality shall be exercised in accordance with Article 363 of the Civil Code of the Republic of Lithuania and the Rules of Retail Trade.
4.3 The Buyer's right to terminate the Purchase and Sale Agreement shall be exercised in accordance with the Civil Code of the Republic of Lithuania and the Resolution of the Government of the Republic of Lithuania (July 22, 2014) on the Approval of the Rules of Retail Trade and the Rules of Retail Trade themselves, which the Buyer shall be entitled to exercise provided that the goods have not been damaged and/or have not been subject to any change in their merchandising appearance, packaging or have not been subject to any usage.
5. Duties of the Buyer
5.1 The Buyer shall pay for the Goods and any other payments due in connection with the execution of the order and shall accept the Goods ordered in accordance with the procedures set out in these Conditions.
5. 2. The Buyer shall pay for the goods ordered in the e-shop www.medeine.lt by bank transfer, cash or consumer credit services provided by leasing companies, depending on the payment method chosen at the time of placing the order. When paying by bank transfer, the Buyer must indicate the order number in the payment destination field, which is sent by e-mail to the Buyer after the order is placed and confirmed.
5.3 The Buyer must inform the Seller of the termination of the contract of sale by email to buitex01@gmail.com within 14 days from the date of delivery of the item when the item is sold. 
5.4 If the data provided by the Buyer in the registration form changes, the Buyer must inform the Seller by email to buitex01@gmail.com
5.5 The Buyer shall comply with these Rules and the requirements set out in the legislation of the Republic of Lithuania.
6. Seller's rights
6.1 If the Buyer attempts to damage or undermines the operation of the e-shop or violates its obligations or these Terms and Conditions, the Seller shall be entitled to terminate the existing purchase and sale contracts without prior notice and to withdraw the Buyer from the possibility of concluding new contracts.
6.2 The Seller may terminate or suspend the operation of the e-shop www.medeine.lt without prior notice.
6.3 The Seller shall have the right to terminate the Purchase and Sale Agreement if the Buyer does not collect his/her order within 5 working days from the date of delivery to the Medeine.lt store.
6.4 The Seller shall have the right to update these Terms and Conditions by posting a notice on the website www.medeine.lt.
7. Duties of the seller
7.1 The Seller undertakes to use all reasonable endeavours to ensure the proper functioning of the e-shop, but makes no warranty that the e-shop will function properly or that the transmission of data will be error-free. 
7.2 The Seller undertakes to fulfil the order within 1-7 working days from the date of placing the order (excluding weekends and public holidays). If the Buyer chooses to pay by bank transfer, the deadline for the execution of the order starts from the date of receipt of the funds in the Seller's account. The Seller must inform the Buyer of any delay in the order completion deadline before the end of the order completion deadline set out in the Terms and Conditions.
7.3.If the Seller is unable to fulfil the order due to important circumstances, the Seller undertakes to offer the Buyer another product from the e-shop catalogue or refund the money paid for the order at the latest within 7 working days. The Buyer shall inform the Seller of his/her choice to receive another product by email to buitex01@gmail.com or by submitting a refund request to the same email, in which he/she shall be sure to indicate his/her personal data and A/S number.
7.4 The Seller undertakes to comply with the other requirements set out in these Conditions.
8. Contract price and payment
8.1 The prices of the goods in the e-shop www.medeine.lt are quoted in euros including VAT. The price of the Purchase and Sale Agreement shall comprise the sum of all the goods purchased and, in the case of delivery of orders to the Buyer's desired location, the cost of transport service. The prices quoted in the e-shop www.medeine.lt are valid for online purchases. Prices may vary in the Medeine.lt shop.
8.2.The Buyer shall pay for the goods ordered in the e-shop by bank transfer, cash or by using consumer credit services provided by leasing companies (the terms of purchase are available in the Medeine.lt shop) depending on the payment method chosen at the time of placing the order.
8.3 The Seller shall have the right, at its sole discretion, to require the Buyer to make an advance payment for the ordered goods. The amount of the advance shall be 10-15% of the price of the goods.
8.4.The Buyer agrees that after the Buyer has placed an order for the goods and the Seller has confirmed it, the price of the goods may change, taking into account factors affecting the price of the goods, such as an increase in the cost price of the goods, a technical error in the information systems, or additional costs related to the sale of the goods to the Buyer (Art.313 para.) If the Buyer does not agree to purchase the goods at the new price, the Seller undertakes to provide an equivalent product at the original order price. In the event of the Buyer's refusal to comply with these conditions, the Purchase and Sale Agreement may be terminated at the initiative of either party.
9. Delivery of goods
9.1 When ordering goods in the e-shop www.medeine.lt, the Buyer may choose the place of delivery of the goods in the Medeine.lt shop or receive the goods at the Buyer's desired address by Medeine.lt transport or parcel delivery company.
9.2 Collection of goods in the Medeine.lt shop is free of charge.
9.3 The cost of delivery to the Buyer's address depends in each case on the weight of the goods. Payment in cash to the courier delivering the goods (C.O.D. service chargeable).
9.4 Bulky Parcels weighing more than 80 kg may be subject to a handling or loading service charge. The Seller shall inform the Buyer of this charge in writing or by telephone prior to the delivery of the Goods and only if the Buyer agrees to the terms of the delivery shall such order be executed.
9.5 Free delivery may apply during promotions, except in the case of bulky items.
9.6 The Buyer undertakes to collect the Goods himself, in cases where the Buyer is unable to collect the Goods, they may be collected by an authorised representative of the Buyer.
9.7 After delivery of the Goods by Buitex transport, the Buyer must inspect the Goods together with an employee for: external damage to the packaging of the Goods that could affect the quality of the Goods. All claims and comments regarding the non-conformity of the delivered goods shall be accepted before signing the delivery document. Any claims for deterioration in the quality of the goods which occur later during the transport, installation or connection of the goods by the buyer shall not be accepted.
9.8.When the goods are delivered by a courier of a parcel company, the Buyer or the Buyer's representative shall, upon receipt of the goods, together with the courier, inspect the condition of the goods' packaging and the quantity of goods. In the event of damage to the packaging of the goods or a discrepancy in the quantity of the goods, the Buyer or the Buyer's representative must not accept the goods if it is possible to contact the Seller. In this case, the courier, together with the Buyer or the Buyer's representative, shall fill in a special consignment inspection report indicating the damage found.
9.9 Once the Buyer or the Buyer's representative has accepted the Goods and has signed on the provided data logger or paper delivery confirmation without comments, the Goods shall be deemed to have been delivered in the undamaged packaging of the consignment and the quantity and quality of the Goods are in accordance with the terms and conditions of the contract of purchase and sale.
10. Product warranty
10.1. www.medeine.lt shall not be liable for material or moral damages caused by a defective device produced by the manufacturer.
10.2 Every product sold in the e-shop www.medeine.lt is covered by the manufacturer's warranty.
10.3 The document evidencing the guarantee shall be a VAT invoice or other document evidencing the purchase (cheque, consumer credit agreement). The warranty shall commence on the date of issue of the VAT invoice or warranty passport.
10.4 In cases where the manufacturer of the Goods carries out the after-sales service, the Seller shall be entitled to refer the Buyer to an authorised service centre representing the manufacturer.
10.5 Information on memory sticks and software is not covered by warranty. The costs incurred by the Purchaser for data loss or recovery shall not be reimbursed.
10.6 The number of permanently glowing or dark dots allowed in LCD displays shall be defined in the manufacturer's specifications. Warranty service shall be provided for devices that do not meet the manufacturer's quality criteria. A number of dark or continuously glowing dots not exceeding these criteria shall not be considered as a malfunction.
10.7 For repaired goods, the warranty conditions apply for the remainder of the warranty period. New replaced goods or components shall be covered by a new manufacturer's warranty.
10.8 The warranty shall not apply if the product's label bearing the serial number is damaged, torn or illegible.
11. Returns and exchanges
11.1 Returns shall be made in accordance with the Resolution of the Government of the Republic of Lithuania (2014-07-22) on the Approval of Retail Trade Rules and the Retail Trade Rules themselves.
11.2.The Buyer has the right to return the purchased product to the Seller within 14 days in cases where the product was purchased in the e-shop and sent to the address specified by the Buyer, i.e. where the Buyer has not had the opportunity to properly assess the functionality and features of the ordered product.
11.3 The Buyer shall be entitled to return to the Seller only such goods which are in perfect merchantable appearance and condition (original equipment, undamaged packaging, in good working order). Unpacking of the goods to assess the quality of the goods shall not be considered as damage to the packaging.
11.4 In the case of return of Goods, replacement of the Goods with similar Goods is also possible, depending on the circumstances and with the consent and/or wish of the Buyer.
11.5 In all cases, money for returned goods shall be paid into the bank account specified by the payer.
12. Responsibility
12.1 The Buyer is fully responsible for the accuracy of the personal data provided by him. If the Buyer fails to provide accurate personal data, the Seller shall not be liable for the consequences arising therefrom and shall be entitled to claim direct damages from the Buyer.
12.2 The Seller shall not be liable for any loss suffered by the Buyer as a result of the Seller's failure to take into account the Seller's suggestions and recommendations, or the Buyer's failure to comply with these Terms and Conditions, even though the Buyer has been given the opportunity to read them.
13. Contingencies
13.1 The Parties shall not be liable for any failure to perform their obligations hereunder, in whole or in part, if such failure is due to Force Majeure. The Parties shall understand force majeure as defined by the Civil Code of the Republic of Lithuania. If the circumstances referred to above last for more than 1 month, the Parties may, by mutual agreement, terminate these Terms and Conditions.
14. Exchange of information
14.1 The Seller shall send all information related to the execution of the order to the e-mail address specified in the Buyer's account.
14.2 The Buyer shall send all notices and questions to the email addresses provided by the Seller.
15. Final provisions 
15.1 These Terms and Conditions are made in accordance with the legislation of the Republic of Lithuania.
15.2 Relationships arising under these Rules shall be governed by the law of the Republic of Lithuania.
15.3 All disputes arising out of the operation or validity of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania, in the city of registration of the company.
